Doctors not liable for potential damages from vaccines: German court

Doctors who administer vaccines against coronavirus are not liable for potential damages, the German Court of Justice (BGH) ruled on Thursday, in a case brought by a man who claimed his jab caused him to contract heart disease, reported dpa.

The Karlsruhe-based court said the state, not individual doctors, bears responsibility for any errors in information or treatment. Claims by injured parties must be directed against federal or state government, it added.

The case involved a man who sued his doctor after being diagnosed with heart disease shortly after receiving a coronavirus vaccine.

He argued that the vaccination was administered incorrectly and that he had not been given sufficient information. As a result, he could no longer do his job and was also severely mentally impaired.

In court, he demanded at least €800,000 in compensation.

The plaintiff was unsuccessful in lower courts, which ruled that the doctor was acting in an official capacity when administering the vaccine and therefore not personally liable. The BGH supported the decisions.

The courts did not rule on whether the vaccination did cause the disease. The question was "who is liable if," emphasized judge Ulrich Herrmann.
